Terms of Use
These Terms govern the use of Console Mix products and services, including the ConsoleMix software, StreamMatrix, the control panel at https://www.consolemix.com.br, and the associated streaming and notification services. By creating an account or using our products, you agree to these conditions.
1.Acceptance
By ticking the acceptance box at registration, installing the software, or using any of our services, you confirm that you have read, understood and accepted these Terms and the Privacy Policy.
If you accept on behalf of a station or company, you confirm that you have authority to bind it. If you disagree with any condition, do not use the products.
2.Definitions
- ConsoleMix — broadcast audio mixing console software, installed on the Customer's computer.
- StreamMatrix — auxiliary audio routing and streaming application.
- Panel — the Customer area at https://www.consolemix.com.br, for managing licenses, links, payments and support.
- License — a time-limited authorisation to use the software, bound to a specific computer.
- Customer — the individual or company holding the account.
3.Subject matter
We grant the Customer a non-exclusive, non-transferable, time-limited license to use the software. You do not acquire ownership of the software — only the right to use it while the license is valid and payments are current.
The license covers the number of channels, stations and features contracted. Expansions require an additional agreement.
4.Registration and account
- You must provide truthful, complete and current information and keep it up to date.
- Each tax identification number corresponds to one account.
- The account is confirmed by e-mail before access is enabled.
- You are responsible for safeguarding your password and for all activity carried out with your credentials.
- If you suspect misuse, notify us immediately at suporte@consolemix.com.br.
5.Licensing and machine binding
Each license is bound to a specific computer through an identifier generated from that machine's characteristics. This means:
- The license does not run simultaneously on more than one computer;
- When changing machines, reformatting or replacing hardware components, you may need to remove and reactivate the license;
- Removal can be done from the software's "About" window or requested from support;
- The software periodically validates the license against our servers. An internet connection is required for this.
6.Pricing, payment and default
- Amounts, billing frequency and payment methods are those stated at purchase or in the Panel.
- Annual price adjustments may apply, with at least 30 days' notice.
- In case of late payment, we notify you through your registered channels. If default persists, the license may be suspended and later cancelled.
- Suspension stops the software from operating, with direct impact on your broadcast.
7.Term, renewal and cancellation
The license runs for the contracted term and renews according to the plan chosen. You may cancel at any time through the Panel or our support channels; cancellation takes effect at the end of the period already paid for.
Right of withdrawal. Where the Customer is a consumer and the contract was concluded at a distance, the withdrawal period set by the consumer protection law of your country applies, allowing you to withdraw without giving a reason.
8.What you may not do
- Copy, distribute, sublicense, rent or resell the software;
- Reverse engineer, decompile, or attempt to circumvent the licensing mechanisms;
- Share credentials, license keys or PINs with unauthorised third parties;
- Use the software for unlawful activity or activity that infringes third-party rights;
- Interfere with our infrastructure or attempt unauthorised access to other accounts.
9.Broadcast content and copyright
Essential for broadcasters. ConsoleMix is a technical tool. All content you broadcast is your sole responsibility — music, programming, advertising and voice content.
It is the Customer's responsibility to obtain and maintain all required licenses and authorisations, including copyright and neighbouring rights with the competent collecting society in your country (ASCAP, BMI, SESAC, SOCAN, APRA AMCOS, SAMRO or equivalent), as well as any applicable broadcasting licences.
Console Mix does not monitor, store, or bear any responsibility for the content you broadcast.
10.Availability, support and maintenance
We work to keep our services continuously available, but we do not guarantee uninterrupted or error-free operation. Availability depends on factors outside our control, such as internet connectivity, electrical power, the Customer's equipment, and third-party services.
We may carry out scheduled maintenance, with advance notice wherever possible. Emergency security maintenance may occur without notice.
11.Intellectual property
The software, source code, interface, the ConsoleMix brand, logos and documentation belong to C Aparecido da Silva and are protected by copyright legislation and applicable international treaties. These Terms transfer no intellectual property rights to the Customer.
12.Limitation of liability
To the fullest extent permitted by applicable law, Console Mix is not liable for lost profits, loss of audience or advertising contracts; failures caused by the Customer's equipment, operating system, network or power supply; unavailability of third-party services; content broadcast by the Customer; or data loss resulting from the Customer's lack of backups.
Where liability is established, it is limited to the amount paid by the Customer in the 12 months preceding the event. Nothing in this clause excludes liability that the law does not permit to be limited, particularly towards consumers.
13.Data protection
The processing of personal data is governed by our Privacy Policy, which forms part of these Terms. Where the Customer processes third-party data — listeners, competition entrants — the Customer acts as controller of that data.
14.Changes to these Terms
We may amend these Terms to reflect changes to the service or to the law. Material changes will be communicated by e-mail or through the Panel at least 30 days in advance. Continued use constitutes acceptance.
15.Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, with jurisdiction in Comarca de Guarapuava, Estado do Paraná, Brasil. Where the Customer is a consumer, the mandatory forums and protections of their country of residence continue to apply.
